I (the “Customer and Report Purchaser”) agree to pay the one‐time charge shown on the Order Form (USD) plus applicable sales tax in the following states: Georgia, California, Illinois, Arkansas, Connecticut, North Carolina, Rhode Island and New York, according to my card issuer agreement. I UNDERSTAND THAT INFORMATION AND DISSEMINATION OF INFORMATION CONTAINED IN HOMECLUE HOME HISTORY REPORT™ (“REPORT”) IS SUBJECT TO REGULATION UNDER THE FAIR CREDIT REPORTING ACT. BY PLACING AN ORDER FOR THE REPORT I STATE AND AFFIRM THAT I AM EITHER PURCHASING OR CONSIDERING PURCHASING THE HOME FOR WHICH THIS REPORT IS BEING ORDERED. I WILL USE THIS REPORT FOR PERSONAL USE ONLY.

Commercial use, resale and redistribution of Report are strictly prohibited. "Commercial Use" is defined as use by persons engaged in the resale or redistribution of Report, decompiling or using data for any purpose other than the evaluation of the home for which the Report is ordered, or any other business purpose as determined by HomeCLUE LLC (“HomeCLUE”). Systematic retrieval of Reports to create or compile, directly or indirectly, in whole or in part, a collection, compilation, database or directory without the express written permission of HomeCLUE is strictly prohibited.

HOMECLUE REPORTS ARE PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPLIED BY AND INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION UNDER APPLICABLE LAW. WHILE REPORT PROVIDES INFORMATION ON MOST HOMES; IT IS NOT POSSIBLE TO PROVIDE ALL THE HISTORICAL INFORMATION ON ANY SPECIFIC HOUSE. IN ADDITION TO REPORT WE ENCOURAGE REPORT BUYERS TO USE OTHER SOURCES OF DATA TO EVALUATE THE HOME, NEIGHBORHOOD AND LOCAL AREA. WE ARE NOT RESPONSIBLE FOR ANY ERRORS OR OMISSION IN INFORMATION. IN NO EVENT WILL HOMECLUE, OR ANY PERSON OR ENTITY INVOLVED IN CREATING, PRODUCING, OR DISTRIBUTING THE REPORTS, BE LIABLE IN CONTRACT, IN TORT (INCLUDING FOR ITS OWN NEGLIGENCE) OR UNDER ANY OTHER LEGAL THEORY (INCLUDING STRICT LIABILITY) FOR ANY DAMAGES, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, CONSEQUENTIAL, OR SIMILAR DAMAGES, INCLUDING, WITHOUT LIMITATION, LOST PROFITS OR REVENUES, LOSS OF USE, OR SIMILAR ECONOMIC LOSS, ARISING OUT OF THE USE OF HOMECLUE REPORTS. IN NO EVENT SHALL HOMECLUE'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION WHETHER IN CONTRACT, TORT (INCLUDING ITS OWN NEGLIGENCE) OR UNDER ANY OTHER LEGAL THEORY (INCLUDING STRICT LIABILITY) EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR OBTAINING ANY REPORTS OR OTHER INFORMATION FROM www.homeCLUE.com or other affiliated HomeCLUE websites. You agree to defend, indemnify, and hold harmless HOMECLUE and its affiliates and their respective directors, officers, employees, and agents from and against any and all claims, actions, demands, damages, costs, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Reports.

I AUTHORIZE HOMECLUE, LLC (“HOMECLUE” AND ITS AGENTS) TO GATHER THE INFORMATION NECESSARY TO COMPILE AND DISTRIBUTE THE REPORT AND I REQUEST A HOMEOWNER INSURANCE POLICY PREMIUM ESTIMATE AND COVERAGE DETAILS FOR THE HOME. I AUTHORIZE HOMECLUE AND THEIR AGENTS TO ORDER A “SOFT‐HIT” CREDIT REPORT AND C.L.U.E.® REPORT/A‐PLUS™ REPORT, AT NO COST TO ME AND THAT WILL NOT APPEAR IN MY CREDIT HISTORY, FOR USE IN THIS TRANSACTION. I AUTHORIZE AN INSURANCE AGENCY TO CONTACT ME TO PROVIDE AN MORE ACCURATE HOMEOWNER INSURANCE QUOTE BASED ON MY UNIQUE REQUIREMENTS AND SITUATION.

This Customer Agreement shall be construed in accordance with the laws of the State of Georgia, without regard to its conflict of laws rules, including but not limited to, the Uniform Computer Information Transactions Act ("UCITA"). I hereby consent to the personal jurisdiction of any state or Federal court of the State of Georgia, acknowledge that venue is proper in the State of Georgia, agree that any action related to this Customer Agreement must be brought in a state or Federal court in the State of Georgia, waive any objection that may exist, now or in the future, with respect to any of the foregoing. No refunds will be provided, unless HOMECLUE is not able to process the Report request. BY ORDERING A HOMECLUE REPORT, I AGREE TO BE BOUND BY THIS AGREEMENT, AND I ACKNOWLEDGE THAT SUCH AGREEMENT CONSTITUTES A BINDING CONTRACT BETWEEN ME AND HOMECLUE, LLC. IF YOU DO NOT AGREE TO THESE TERMS OF USE, PLEASE DO NOT ORDER A REPORT.
